Terms and Conditions of Accommodation
Finca Mabasa
By making a reservation and staying at Finca Mabasa, guests fully accept these Terms and Conditions of Use and Accommodation.
Finca Mabasa is a holiday rental property located in the natural surroundings of Roque Aguayro, designed to offer a peaceful experience focused on relaxation, privacy, and connection with nature. All guests agree to respect the property, its facilities, the surrounding environment, and the rules outlined below.
1. Use of the Property
The property is intended exclusively for tourist accommodation during the contracted stay.
Professional, commercial, industrial, advertising, or business activities are not permitted on the premises.
Parties, events, large gatherings, or any activity that may cause disturbance to neighbours or the surrounding area require prior written approval from the property owner.
2. Occupancy and Guest Registration
The reservation holder must provide the exact number of guests who will occupy the property.
The accommodation includes:
Two double bedrooms with private en-suite bathrooms.
One shared guest toilet.
One sofa bed suitable for up to two additional guests.
The maximum authorised occupancy may not be exceeded without prior approval.
The presence of undeclared guests may result in immediate termination of the booking without refund.
All guests must provide the documentation required under current traveller registration regulations.
3. Check-in and Check-out
Check-in: From 3:00 PM
Check-out: Until 11:00 AM
Late departures may incur additional charges if they affect cleaning schedules or subsequent bookings.
4. Reservations, Payments and Cancellations
The full amount of the stay must be paid at the time of booking using the payment methods provided by the property.
Cancellation Policy
More than 30 days before arrival: 100% refund.
Between 30 and 8 days before arrival: 50% refund.
Between 7 and 3 days before arrival: 50% of the booking amount will be retained.
Within 48 hours of arrival or in the event of a no-show: no refund will be issued.
5. Security Deposit
A security deposit of €200 will be required to cover potential damages, losses, breakages, or extraordinary cleaning costs.
The deposit will be refunded within 48 hours after check-out, subject to inspection of the property.
If any damage exceeds the value of the deposit, guests agree to pay the remaining balance.
6. Care of the Facilities
Guests are expected to use all furniture, appliances, equipment, and facilities responsibly and with due care.
The following are not permitted:
Moving indoor furniture outdoors, except furniture specifically intended for outdoor use.
Tampering with electrical, plumbing, irrigation, or technical installations.
Altering the layout or configuration of the property without authorisation.
Any damage or malfunction must be reported immediately.
7. Cleaning and Waste Disposal
Guests must leave the property in a reasonably clean and tidy condition.
All rubbish must be disposed of in the designated waste containers.
Leaving waste in gardens, terraces, pathways, or any area of the property is strictly prohibited.
8. General Safety Rules
For safety reasons, the following are strictly prohibited:
Smoking inside the property.
Lighting fires outside designated barbecue areas.
Using fireworks or pyrotechnic materials.
Tampering with fire extinguishers or emergency equipment without valid reason.
In case of emergency, guests should call 112.
9. Swimming Pool
The swimming pool is used entirely at the guests’ own risk.
No lifeguard service is provided.
Mandatory Pool Rules
Entry to and exit from the pool must be made exclusively via the designated ladder.
Diving, jumping, or any similar activity is strictly prohibited.
Running, pushing, or dangerous games around the pool area are not allowed.
Glass containers or glassware are not permitted in the pool area.
The pool may not be used outside daylight hours.
The pool must not be used under the influence of alcohol or substances that impair physical or cognitive abilities.
Children
Minors must be supervised at all times by a responsible adult.
The property accepts no liability for accidents resulting from inadequate supervision.
10. Barbecue Use
The barbecue must be used responsibly and supervised at all times while in operation.
It may never be left unattended.
Guests must comply with any restrictions related to weather conditions, fire risk alerts, or local regulations.
11. Rural Environment and Agricultural Activity
Finca Mabasa forms part of an active agricultural property located in a rural environment.
During your stay, agricultural work, irrigation, pruning, maintenance activities, or the movement of staff and agricultural vehicles may take place.
Guests acknowledge and accept that rural environments may involve natural sounds, agricultural machinery, insects, birds, reptiles, domestic animals, and occasional rural odours.
These circumstances are considered normal features of the location and do not constitute defects or service failures.
12. Protection of the Natural Environment
The property is located within the surroundings of the Roque Aguayro Natural Monument, a protected area of significant geological, environmental, and scenic value.
The following activities are strictly prohibited:
Lighting bonfires or open fires.
Using fireworks or pyrotechnics.
Graffiti, carving, or marking natural surfaces.
Installing signs, banners, or temporary structures.
Altering the natural terrain.
Digging, excavating, or moving rocks.
Damaging vegetation.
Leaving waste outside designated disposal areas.
Guests will be held responsible for any environmental or property damage caused during their stay.
13. Complimentary Welcome Products
The property may occasionally provide complimentary welcome products free of charge.
These items are offered as a courtesy and do not form part of the accommodation contract.
Guests are responsible for ensuring that any products provided are suitable for their dietary requirements, allergies, intolerances, or medical conditions.
The property cannot guarantee the absence of allergens and accepts no responsibility for adverse reactions, except where required by law.
14. CCTV Surveillance
For security purposes, CCTV cameras monitor only the access points and external parking areas.
There are no cameras inside the accommodation or in any areas intended to ensure guest privacy.
15. Personal Belongings
The property accepts no responsibility for loss, theft, damage, or misplacement of guests’ personal belongings during their stay.
Items found after departure will be retained for a reasonable period to facilitate their return.
16. Right of Access and Early Termination
The property owner reserves the right to access the premises when necessary to:
Respond to emergencies.
Carry out urgent repairs.
Verify serious breaches of these terms.
Protect the safety of individuals or the property.
Serious violations of these Terms and Conditions may result in immediate termination of the stay without refund.
17. Data Protection
Personal data will be processed in accordance with the General Data Protection Regulation (GDPR) and applicable Spanish data protection legislation.
Data will be used solely for reservation management, accommodation services, and compliance with legal obligations relating to traveller registration.
Guests may exercise their rights of access, rectification, erasure, restriction, portability, and objection by contacting the property.
18. Applicable Law
These Terms and Conditions shall be governed by and interpreted in accordance with Spanish law.
Both parties agree to attempt to resolve any dispute amicably before pursuing legal action.
Should a resolution not be reached, any dispute shall be submitted to the courts and tribunals having jurisdiction under applicable consumer protection and legal regulations.
